Terms and Conditions

USAGE OF PHOTOS
We will never use your photos alongside your name or personal information, except for the school name when applicable. Those Photo Ladies retains ownership of all images and may use them for advertising purposes. We respect each school's "Do Not Photograph" list, and students on that list will not have their images shared publicly. Please note: if your child is on the Do Not Photograph list, their images may no longer be accessible after the ordering period ends.

PRINT RELEASE
A print release allows the purchaser to print the digital files they’ve bought. However, we cannot guarantee the quality of prints made through third-party services. The release applies only to the individual who purchased the files. You may print copies and create photo products for personal use only. Sharing digital files with others is not permitted. The copyright for all images remains with Those Photo Ladies and Kaitlin Roten unless explicitly stated otherwise.

COPYRIGHTS AND TRADEMARKS
All content on thosephotoladies.com is the property of Those Photo Ladies, including images, text, logos, and design elements. You may only use content from our site for browsing, placing an order, or similar actions directly related to purchasing. Unauthorized use, including copying, modifying, or distributing materials, is strictly prohibited and may result in legal action.

DISCLAIMER AND LIMITATION OF LIABILITY
Due to the custom nature of our work and the risk of digital misuse, digital products are non-refundable. We will replace items damaged in shipping or incorrectly identified images within 10 days of delivery. It is the buyer's responsibility to download and back up their images during the available timeframe. After the ordering period ends, we may not be able to provide access again.

RETURN POLICY
All sales of digital files are final. Edits are completed prior to delivery and RAW files are not available. By purchasing, you agree to the files as edited and approve the cropping as displayed. While adjustments can be made during ordering, changes after purchase may not be possible.

Replacements for shipping damage or misidentified images will be issued if requested within 10 days, provided:

  • All products are returned in full.

  • Items were not intentionally damaged.

  • Returns are shipped prepaid.

  • All shipping fees are non-refundable.

  • Please allow 2-3 weeks for replacements.

  • Missing item claims must be made within 10 days of shipping.

PRIVACY & SECURITY POLICY
We do not sell, trade, or rent your personal information. We use your data solely to process orders and enhance your shopping experience.

ORDER ACCEPTANCE POLICY
Submitting an order or receiving a confirmation does not guarantee order acceptance. We reserve the right to cancel or request additional information at our discretion.

TYPOGRAPHICAL AND PHOTOGRAPHICAL ERRORS
We strive for accuracy, but errors may occur. In the event of a pricing or content mistake, we may cancel or revise orders. We also reserve the right to make artistic cropping decisions for final products.

UNAUTHORIZED RETURNS
Refused or undeliverable packages will incur a 15% fee plus shipping and handling charges.

JURISDICTION
Those Photo Ladies is based in Brevard County, Florida. All disputes will be governed by Florida law and resolved in Brevard County courts.
